Brodie Butler Photography retains copyright and all moral rights in each image produced and retains ownership of all original captures and processed files supplied. Unless otherwise agreed upon in writing, the images are supplied on a non-exclusive basis.
Brodie Butler Photography retains the right to use the images and/or video for self-promotion and for portfolio purposes including but not limited to his website and social media such as instagram and facebook. Services are charged at a discounted rate with this in mind.
The standard turn around for images is 10 business days. Please consult with Brodie as turn around times may vary depending on the package you have purchased or any special circumstances.
While every effort is made, your satisfaction cannot be guaranteed. If you would like to opt to keep the work produced private you must consult Brodie Butler as this may affect your cost.
IMAGE USAGE LICENCE: Unless otherwise stated, by default the creator of the work (“Work”) grants to you defined herein (“Client”) a Non-Exclusive license to use the Work in Australia for non-commercial personal uses only. This license shall be valid for An Unlimited Time. Any other use of the Work by the Client shall require a separately negotiated license. A Printing licence will be issued if you purchase High Resolution Digital Files. Images can not be used for paid subscription sites such as OnlyFans or Patreon without permission.
DEPOSIT: A non-refundable deposit is required to secure your booking on a specific date with the remainder to be paid on or prior to the day. (Cash, Paypal, Direct Debit available). Image licences are not transferred until payment is made. The amount will be stated in your photoshoot package.
CANCELLATIONS: Cancellations at any time will forfeit your deposit. Deposits are required to secure a certain date and are non-refundable. Please ensure you are available on the date that you book and commit to it. Cancellations occur at an alarming rate and have a detrimental effect on my business while other people also miss out.
COVID-19: If you cancel due to contracting COVID-19 I will allow you to transfer your deposit to an alternative shoot date if you let me know more than 48 hours in advance. For special events and location events this is not possible as your deposit is covering the location cost. If you can provide someone else to take your place you can receive your deposit back.
If the government imposes a lockdown that prevents our shoot or event from going ahead, I will allow all deposits to be transferred to another date and in certain circumstances at my discretion, refunded in full.
RE-SCHEDULING: If you wish to reschedule your photoshoot, and you have given ample notice, you may be able to transfer your deposit to the new date at the discretion of Brodie Butler Photography. Unlikely for special events. If ample notice is not given you will lose your deposit that was securing the previous shoot date, and will be required to make another deposit. Please ensure you are available on the date that you book and commit to it. Rescheduling requests occur at an alarming rate and have a detrimental effect on my business and other people miss out.
RAW PREVIEWS: All raw previews are proofs that come in a low resolution watermarked image for future reference only.
RAW IMAGES: If you purchase all the raw files, this refers only to the unedited images in their web resolution wallpaper size. (longest side 2048 pixels long). The actual high resolution original .CR2 RAW Camera files are not provided. If you require printing you must contact Brodie Butler Photography. Original size high resolution images may be available to purchase for printing.
ENHANCED/EDITED PHOTOS: These photos are not retouched, but are designed to look more natural with a colour graded finish, perfect for social media content. All images come in a high quality web resolution (2048pixels on longest side). These are not suitable for printing and do not include a printing licence.
RETOUCHED PHOTOS: These photos are a full retouch using Brodie Butler’s trademark retouching process. Elaborate manipulations and high end in-depth retouching are not included. All final retouched images come in a high quality web resolution (2048pixels on longest side). These are not suitable for printing and do not include a printing licence.
RETOUCH REQUESTS: Any requests must be made prior to any retouching. Requests will be considered but are not guaranteed to be included if they are deemed outside the scope or unnatural and unwarranted. Additional requests will incur a fee.
TATTOO REMOVAL: If it’s minor then that’s not a problem, but removal of major tattoo’s or any other major enhancements require an additional fee.
HIGH RESOLUTION: These images are suitable for printing at home, business cards and posters and a printing licence will be issued.
OUTFITS: You can change outfits as many times as you like within the given time frame. Less outfits allows you to spend more time in front of camera!
24 HOUR DELIVERY: Must be pre-booked and approved and starts once your images to be edited have been selected. Images will be delivered within 24 hours from Midnight if selections are submitted after 12pm. If submitted before 12pm, images will be delivered within 24 hours of 12pm. Payment must also be cleared. (Same applies to 48 hour delivery add-ons)
STUDIO SHOOTS: If a studio is desired, an additional fee is required to book a studio.
EXCESS TRAVEL: A travel fee is applied if your location is outside the Perth metro area.
Images Can Not be used Commercially in anyway without permission.
Brodie Butler Photography shall not be liable for any legal action, claim or damages resulting from or arising out of the use of, publication or distribution of the images. You agree to indemnify Brodie Butler Photography against any claims and/or damages against him including any legal fees arising from the images.
